Terms & Conditions

The following terms and conditions below cover the sale of goods from 360-PAC ("the Company") to you ("the Customer").

Price and Ordering
0% Zero VAT for european customers
Option 1: Place the order and pay the VAT, then send us your valid european VAT number via the order notes or via email to sales@360pac.com and we will refund the VAT and assign 0% VAT to your online account for you to make future orders via our website with the vat charged at 0%.
Option 2: Sign up to our website here and then send us your email address that you have used to registered with our website. Please also send us your VAT number, company name, company address details. Once we have checked the details are eligible for 0% rate vat, we will then apply the 0% VAT rate to your online account for you to make future orders via our website with the vat charged at 0%.
A.0 All Prices shown on www.360pac.com are including VAT at 20%

A.1 By using our website you agree to the use of cookies on our website and your session in line with the European Directive 2009/136/EC Please see our Privacy and Security page on how your cookies are handled.
A.2 Minimum order with our website is £500+vat (Temporarily set to £150+vat)

A.2.1 The price payable for the goods is the price shown on the web site at the time the Customer places their order.

A.3 When you receive confirmation of an order this is to indicate that the Company have received the Customer's order. It does not indicate that a contract exists between the Customer and the Company. Acceptance will occur when we dispatch the goods to you. The Company have included this term to protect against a mistake in pricing, where the Company has inadvertently under-priced or over-priced goods, or the Company are no longer able to supply a particular product for some reason.

A.4 In the case of a change of price, the Company will always contact the Customer first to ensure that the price is acceptable.

A.5 If the product is no longer available the Company will seek to offer the Customer a suitable alternative.

A.6 The Company accepts all major credit cards except American Express, we also accept Paypal and Bank Transfer (these must clear before goods will be dispatched) as valid methods of payment.

A.7 In the event that items are not in stock and are not available the Customer will be given the option to cancel the order. If the Customer cancels the order they will not be charged. Goods can be back ordered.
A.8 We try our best to make sure all pricing and descriptions of our products are correct, in an event that a price or descriptions is incorrect we withhold the right to not sell the product or service.
A.9 Buy Smiths uses many manufacturers and suppliers, we cannot be held responsible for delays in service to our company, nor product changes which we have not be notified about, for example changes of colour or construction of any product. 
A.10 Buy Smiths discounts and voucher codes, all customers who use our discounts and discount voucher codes, much be a registered member of the website to be able to receive or enter a discount voucher code. Buy Smiths holds the right to refuse any discount code or withdraw its discounts and discount codes at anytime.
A.11 Language translate: 360-PAC use Google translator for the language translator for the websites. 360-PAC will hold no responsibility for the mistranslation of any word, product, description, diction, or correct manner that may display if Google translator was to show any. 360-PAC holds the right to withdraw any product and refuse return of any product if a mistranslation is found.
Delivery and Title

B.1 For the purposes of this section "a Working Day" is defined as Monday to Friday excluding public holidays in .

B.2 Delivery is restricted to Europe only.

B.3 Where stock is available the Company will deliver the Customers order in accordance with the delivery schedule set out below. Refer to Back Orders where stock is not available. 
B.4 All delivery dates are estimates only and the Company can not be held liable for any delay in delivery of the goods howsoever caused.

B.5 Title to the goods will only pass to the Customer on receipt of payment in full of the price of the goods including all relevant taxes and delivery costs. The Company reserves the right to repossess goods in the Customer's possession if payment is not made in full.

Back Orders
C.1 By using the red 'Back Order' button you accept that the product will be sent as a back ordered item, and can take anytime between 1 to 4 weeks to arrive depending on the stock availability. If the product you have accepted to back order becomes a discontinued product during the back order period, we will notify you via email or phone. We do not accept any responsibility for loss of business, custom or cost during or from the use of the back order feature.

C.2 If the items the Customer is ordering are not in stock, the Company will despatch when back in stock, the Customer will be quoted an estimated delivery date or offered a suitable alternative if the item is no longer available. The Customer will always be emailed with the option to cancel their order if they do not accept the new delivery date or the alternative item offered is not acceptable.

Tax Charges

D.1 All orders will have 20% VAT added.
D.2 All prices on the website are including VAT

Credit Card Security

E.1 When the order is placed at the Company's website, credit card numbers are encrypted using 128 bit encryption. They are only decrypted after they reach the Company's computer. They are not held in clear text on any web site.

6. Cancelling Rights

F.1 Please note that you are entitled to cancel this contract if you so wish, provided that you exercise your right in writing and it is received by us within 14 working days of receipt of order. All goods must be returned by the customer at their expense.
F.2 The Customer must notify the Company in writing by letter, fax or email within 14 working days of delivery.

F.3 The Customer will bear the cost of returning the goods to the Company unless the goods are being returned because they are defective, in which case the Company will arrange for the goods to be collected by their nominated carrier. All customers are obliged to retain possession of goods and take reasonable care of them.
F.4 Please note that if you wish to cancel your order once dispatched, this is only possible in accordance with the procedure given here. Simply refusing delivery of your parcel is not in accordance with these terms and conditions.
F.5 On receipt of the goods by the Company the Customer will receive a credit, exchange or refund to the total value of goods returned subject to the goods being returned in an unspoilt, saleable condition.

Liability

G.1 Any defect in the quality, quantity and condition of the goods should be notified by the Customer to the Company, on receipt of the goods and the delivery should be signed for as damaged and the Company contacted immediately. Simply signing unchecked is insufficient. If the Customer does not notify the Company and just refuses the delivery the Company will not accept liability for such defect and the Customer will required to pay for the goods in full as if delivered.

G.2 The Company will inspect the goods returned and if the defect is identified, the Customer will be given the option of replacement at no additional cost or a full refund of the price of the goods. The Company will have no further liability to the Customer.

G.3 The Company will inspect the goods returned and if no defect is identified the goods will be returned to the Customer at the Customer's cost.

G.4 The Company under no circumstances will be liable to the Customer for any loss of profits, additional costs, indirect or consequential loss or damage arising out of any defect in goods supplied. The Company's liability will be restricted to the value of goods returned found to be defective on inspection. This does not affect your statutory rights as a consumer or the Company's liability to the Customer for fraudulent misrepresentation or for death or injury resulting from the Company's negligence.

G.5 - 10% +/- (plus/minus) Stock Tolerance - Although the suppliers we use do their best to ensure that the stock provided to us is accurate, there can be a slight differential quantity due to the high speed the production machines run at. Our manufacturers work to a +/- 10% tolerance for all products which are closed in cartons/wrapped. If your products are outside of this tolerance level, we recommend contacting us for further information.

Privacy Policy

H.1 The Company does not disclose any Customers information to third parties other than when order details are processed as part of the order fulfilment. In this case, the third party will not disclose any of the details to any other third party.

H.2 Cookies are used on this shopping site to keep track of the contents of the Customers shopping cart, to store delivery addresses if the address book is used and to store the Customer details if you select the 'Remember Me' Option. They are also used after the Customer has logged on as part of that process. The Customer can turn off cookies within your browser by going to 'Tools | Internet Options | Privacy' and selecting to block cookies. If the Customer turns off cookies, the Customer will be unable to place orders or benefit from the other features that use cookies.

Returns Policy

J.1 The Customer's rights to return goods are protected under the EU Distance Selling Directive.

Force Majeure

K.1 The Company shall have no liability to the Customer for any failure or delay in supply or delivery or for any damage or defect to the goods supplied or delivered caused by any event or circumstance beyond the Company's reasonable control.

General

L.1 The validity, legality or enforceability of any part of these terms and conditions will be unaffected by the invalidity, illegality or unenforceability of any individual part of these term and conditions.

L.2 The terms and conditions shall be governed by and interpreted in accordance with English Law.
